Special judge (PCA) accepted the closure and final report filed by CBI against Nabam Tuki in a 2006 corruption case

Itanagar, A special court at Yupia near here on Thursday accepted a closure report filed by the Central Bureau of Investigation (CBI) against former Arunachal Pradesh Chief Minister Nabam Tuki in a case related to alleged corruption and forgery dating back to 2006.

The CBI, which on the directions of Gauhati High Court registered a case against Tuki and three others under Sections 120B, 468, 471, 477A of Indian Penal Code (IPC) and Sec 7/8/13(2) r/w 13(1) (d) of Prevention of Corruption (PC) Act, 1988, had prayed for accepting the closure report in the form of ‘Final Report’ and to close the case “due to insufficient material evidences against the named accused persons in the FIR”.  

The Court of Special Judge (PCA), Yupia, which took up the matter on December 14 for hearing on Final Report, in its order dated December 23, 2021 said, “After hearing the learned counsels for the parties and also after careful perusal of entire documents annexed therein, this court is of the considered view that the Final Report filed by the CBI can be accepted and matter is accordingly closed and disposed of.”

The brief fact of the case is that on the basis of Public Interest Litigation filed by one Nabam Tagam before Gauhati HC in the year 2006 and the same was registered as PIL No. 76/2006. However, the same was prayed for and withdrawn by the petitioner in the year 2010. But the HC rejected the prayer of the petitioner and the matter had been taken as suo-motu writ petition and directed the CBI for conducting preliminary enquiry into the allegations.

The allegations in the writ petition were that during the year 2005-06, Tuki, the then Minister of PWD and Urban Development had illegally awarded contract works to his kith and kin without following the norms and inviting tenders. Besides, it was also alleged that Tuki opened a fictitious account in the United Commercial Bank to siphon off all the ill gotten money in collusion with his brother Nabam Tagam.

“In compliance of the High Court order, the CBI has approved registration of 11 nos of preliminary enquiries at different branches of CBI for enquiring the matters on the basis of works carried out by PWD, Arunachal Pradesh including the five enquiries of contract works executed within the state of Arunachal Pradesh. However, during investigation, the allegations could not be proved. Therefore, the investigating agency did not file a charge sheet against the accused persons due to insufficient material evidence to prove the allegations and prayed that a closure report dated 22.02.2021 may be accepted and closed the case.”

Since the case was registered on the basis of direction of Guwahati HC in a writ petition, the writ petitioner Nabam Tagam, as per the provisions of law, was directed to appear before the court and to file an objection, if any, on the closure report filed by the CBI. Accordingly, on July 20, 2021 the complainant filed an interlocutory application submitting that he “has no objection on closing of the case as prayed by the CBI”.
